These Terms of Service (“Terms”) govern your access to and use of tokenisedetfs.com (“the Platform”), published and operated by The Vanderbilt Portfolio AG, a company organized under Swiss law with offices in Zurich, Switzerland (“we,” “us,” “the Publisher”). By accessing or using any portion of the Platform, you indicate your agreement to these Terms in their entirety. If you do not agree, you must cease using the Platform immediately. These Terms apply to all content available on the Platform, including treasury ETF analysis, yield product coverage, entity profiles, product comparisons, risk metrics, market access guides, our dashboard, and glossary.
No Financial or Investment Advice
All content published on tokenisedetfs.com is provided strictly for informational and educational purposes. This Platform publishes independent research and analysis on tokenized exchange-traded fund products, tokenized treasury instruments, and yield-bearing digital assets, including products such as BlackRock BUIDL, Franklin Templeton BENJI, Ondo OUSG, Ondo USDY, Hashnote USYC, and Maple Finance syrupUSDC. Notwithstanding the specificity of this analysis, nothing published on the Platform constitutes:
- Investment advice or a recommendation to purchase, sell, redeem, or hold any tokenized fund product, security, cryptocurrency, stablecoin, or other financial instrument.
- A solicitation or offer to participate in any investment, token sale, fund subscription, or financial transaction.
- Legal, tax, or regulatory advice regarding the treatment of tokenized securities under any jurisdiction’s laws.
- A guarantee of any investment return, yield rate, or principal preservation. AUM figures, APY rates, and other metrics published on the Platform (such as BUIDL’s reported 3.46% APY or syrupUSDC’s 4.89% APY) are historical observations and are not projections of future performance.
The tokenized fund products discussed on this Platform carry risks including smart contract vulnerabilities, counterparty default, regulatory changes, liquidity constraints, and underlying asset value fluctuations. Our risk metrics framework is an analytical tool — not a risk guarantee. You must consult qualified financial advisors, legal counsel, and tax professionals before making any investment decisions. The Publisher bears no responsibility for investment decisions made by users of this Platform.
Acceptable Use
You agree to use the Platform exclusively for lawful purposes and in compliance with these Terms. You shall not:
- Reproduce, distribute, or republish Platform content — including our proprietary AUM data, yield calculations, risk scoring methodologies, and comparison matrices — for commercial purposes without a written license from The Vanderbilt Portfolio AG.
- Deploy automated tools (scrapers, crawlers, bots, data harvesting scripts) to systematically extract data from the Platform. Our data update cadence involves significant editorial effort, and unauthorized extraction undermines the sustainability of our free research.
- Attempt to access restricted areas of the Platform, its servers, databases, or administrative interfaces.
- Introduce malicious code, viruses, or disruptive payloads through or to the Platform.
- Use Platform content to create derivative data products or competing research services without authorization.
- Frame, mirror, or embed Platform pages within another website without prior written consent.
- Misrepresent your identity or affiliation when interacting with the Platform or its personnel.
Violation of these provisions may result in immediate termination of your access, at our sole discretion and without prior notice.
Intellectual Property
All content on tokenisedetfs.com — including written analysis, data tables, AUM and yield figures, proprietary risk scoring frameworks, product comparison matrices, entity profiles, glossary definitions, visual assets, logos, and the overall site architecture — is the intellectual property of The Vanderbilt Portfolio AG, protected by Swiss and international copyright law.
Permitted use. You may read and reference Platform content for personal, non-commercial purposes. Limited quotation is permitted for commentary, criticism, news reporting, and academic research, provided such use constitutes fair use under applicable law, and proper attribution is given with a hyperlink to the original page on tokenisedetfs.com.
Commercial licensing. Any use of Platform data or analysis in commercial products — including institutional research reports, client presentations, fund marketing materials, compliance assessments, or competing data services — requires a data licensing agreement. Trademarks. “Tokenised ETFs,” the Tokenised ETFs logo, and “The Vanderbilt Portfolio” are trademarks of The Vanderbilt Portfolio AG. Third-party trademarks referenced on this Platform (BlackRock, BUIDL, Franklin Templeton, BENJI, Ondo Finance, OUSG, USDY, Hashnote, USYC, Maple Finance, syrupUSDC, and others) belong to their respective owners and are used for informational purposes only. Their mention does not imply endorsement by or affiliation with The Vanderbilt Portfolio AG.
Data Accuracy and Verification
As described in our methodology, we employ a multi-source verification approach: AUM figures are cross-referenced against on-chain data, RWA.xyz aggregates, and issuer disclosures; yield rates are verified against smart contract state and published NAV data; and discrepancies exceeding 2% trigger manual review. Despite these rigorous standards, the tokenized fund market operates across multiple blockchains and jurisdictions with varying disclosure standards. Accordingly, we do not warrant that every data point on the Platform is free from error at all times.
Data on the Platform reflects conditions at the time of publication or last update. Markets, yields, and AUM fluctuate continuously — the figures you see may have changed by the time you read them. Always verify critical data against primary sources before relying on it for any purpose.
Disclaimers
“As is” basis. The Platform and all content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. The Vanderbilt Portfolio AG disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
No guarantee of availability. We do not guarantee that the Platform will be continuously available, uninterrupted, or free from technical errors. We may suspend, modify, or discontinue any feature or section of the Platform without notice.
Third-party data. Significant portions of our analysis rely on data from third-party sources — including RWA.xyz, DeFi Llama, blockchain indexers, and fund issuer disclosures. We are not responsible for the accuracy, completeness, or timeliness of third-party data. Changes in data provider methodologies, blockchain reorganizations, or issuer reporting delays may temporarily affect the accuracy of information displayed on the Platform.
Limitation of Liability
To the fullest extent permitted by applicable law, The Vanderbilt Portfolio AG, its directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:
- Your use of or reliance on any content, data, analysis, or information published on the Platform.
- Investment losses, missed opportunities, or adverse financial outcomes attributed to information found on the Platform.
- Errors, omissions, or inaccuracies in published data, including AUM figures, yield rates, risk scores, or entity profiles.
- Unauthorized access to or alteration of your transmissions or data.
- Service interruptions, downtime, or data loss.
In no event shall our total aggregate liability exceed one hundred Swiss francs (CHF 100). This limitation applies regardless of the legal theory under which liability is asserted, including contract, tort, negligence, strict liability, or any other basis.
Third-Party Links and Services
The Platform links to third-party websites and services, including fund issuer portals (BlackRock, Franklin Templeton, Ondo Finance), data providers (RWA.xyz, DeFi Llama), blockchain explorers, and regulatory authority websites. These links are provided for informational reference only. We do not endorse, control, or accept responsibility for the content, privacy practices, or availability of third-party sites. Your interactions with third-party sites are governed by their own terms and policies.
User Communications
When you submit communications to us — including contact emails, methodology feedback, data correction requests, or licensing inquiries — you grant The Vanderbilt Portfolio AG a non-exclusive, royalty-free, worldwide right to use, store, and process the content of your communication for the purpose of responding to your inquiry and improving Platform accuracy. You represent that your communications do not infringe any third party’s rights.
Privacy and Cookies
Your use of the Platform is subject to our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. These policies describe our data collection practices, your rights regarding personal data, and how you can manage cookie preferences.
Indemnification
You agree to indemnify, defend, and hold harmless The Vanderbilt Portfolio AG, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any applicable law or third-party rights.
Governing Law
These Terms are governed by and construed in accordance with the substantive laws of Switzerland, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
Dispute Resolution
Disputes arising from these Terms or your use of the Platform shall first be pursued through good-faith negotiations between the parties for a period of 30 days. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of the Canton of Zurich, Switzerland. The Publisher reserves the right to seek injunctive relief in any competent court to protect intellectual property rights.
Severability and Waiver
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect. The invalid provision shall be interpreted to achieve its original purpose to the greatest extent permitted by law. Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
Modifications
We reserve the right to modify these Terms at any time. Changes take effect upon posting to the Platform with an updated “Last updated” date. Material changes may be accompanied by a notice on the Platform. Continued use after modification constitutes acceptance of the revised Terms.
Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the complete agreement between you and The Vanderbilt Portfolio AG regarding your use of tokenisedetfs.com, superseding all prior agreements and understandings.
